India service business: TECSA Enterprises Private Limited · Platform and data management: TecSA Software Services Sdn Bhd (Malaysia)
Effective date: 24 July 2026 · Company responsibilities clarified: 15 October 2026
1. About These Terms
These Terms of Service (“Terms”) govern access to and use of the Fixiyo mobile applications, website and
related services (the “Platform”). The Fixiyo app, technology platform, servers and customer databases are managed by TecSA Software Services Sdn Bhd (Malaysia). Local service-business operations in India are handled by TECSA Enterprises Private Limited (together, “TecSA”, “Fixiyo”,
“we”, “us” or “our”). By creating an account, requesting or accepting a service, or otherwise using the
Platform, you agree to these Terms and the Fixiyo Privacy Policy.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding contract. You must provide
accurate, current information and keep your account details updated. You are responsible for activity under
your account and must protect passwords, one-time codes and devices.
Fixiyo may require identity, business, qualification or other verification. Verification helps reduce risk
but is not a guarantee of a person’s conduct, skill or suitability.
3. How Fixiyo Works
Fixiyo enables customers to request home or field services and enables eligible providers or service partners to
receive, accept and manage jobs. Depending on the booking, services may be performed directly by Fixiyo, by an
affiliated or partner service company, or by an independent provider.
Where an independent provider performs the service, that provider is responsible for carrying out the work
with reasonable care and skill and for complying with applicable licensing, safety and tax requirements.
4. Bookings, Inspection and Approval
A booking request is not confirmed until the Platform shows confirmation or an assigned provider accepts the
job. Availability, service area and estimated arrival times are not guaranteed and may change because of
traffic, weather, provider availability, safety concerns or events outside reasonable control.
Prices shown before inspection may apply only to the selected standard service. If inspection reveals
additional labour, parts, access issues, safety risks or a different fault, the provider must present the
additional scope and price for customer approval before proceeding, except where immediate action is
reasonably necessary to prevent injury or serious property damage.
Customers must review the service description, exclusions, quantity, appliance details, address, schedule and
price before confirming. Providers must not perform or charge for material additional work without recorded
customer approval.
5. Prices, Payments and Taxes
Prices, platform fees, taxes, parts charges, call-out charges and other amounts will be displayed in the
Platform or communicated for approval before charge where reasonably practicable. You authorize Fixiyo and its
payment providers to process amounts due using the selected payment method.
Payment availability and refund timing may depend on third-party payment providers and banking systems.
Providers are responsible for their own tax obligations unless law requires Fixiyo to collect, withhold or
remit amounts.
6. Cancellations, Rescheduling and Refunds
Cancellation, rescheduling, no-show, diagnostic and refund conditions shown in the Platform at the time of
booking form part of these Terms. A cancellation fee may apply where a provider has accepted, travelled,
arrived, purchased approved parts or begun work.
Approved refunds will normally be returned to the original payment method, subject to processing times. A
refund does not limit any non-excludable consumer right.
7. Customer Responsibilities
Customers must provide accurate contact, address, access and service information; ensure an adult is present
where required; provide safe and lawful access; disclose known hazards; secure pets and valuables; obtain
required permissions; and provide utilities, parking or access reasonably needed for the service.
A provider may refuse or stop work where conditions are unsafe, unlawful, abusive, discriminatory, materially
different from the booking, or likely to damage property or equipment.
8. Provider and Service Partner Responsibilities
Providers and service partners must maintain required licences, qualifications, insurance and tools; comply with
safety and professional standards; respect customer property and privacy; provide honest inspection findings
and pricing; use approved workflows; keep accurate job records; and avoid harassment, discrimination,
unauthorized subcontracting, off-platform circumvention or misuse of customer data.
Providers must use customer information only to perform the relevant booking and must not retain, disclose or
market to customers except as permitted by law and Fixiyo policies.
9. Location, Tracking and Communications
The Platform may use precise location for service-area checks, navigation, arrival estimates, job verification
and live tracking. Live tracking may be approximate and can be affected by device settings, connectivity and
map-provider data. Users must not rely on tracking for emergencies.
You consent to receive service-related calls, chats, emails, SMS and push notifications. Standard carrier
charges may apply. Call audio is not recorded unless participants are clearly notified and any legally
required consent is obtained.
10. Photos, Videos, Reviews and Other Content
You retain ownership of content you submit. You grant Fixiyo a worldwide, non-exclusive, royalty-free licence
to host, store, reproduce, display and use that content as reasonably necessary to operate, secure, improve
and support the Services, resolve disputes and meet legal obligations.
You must have the right to upload content and must avoid unnecessary personal, confidential or third-party
information. Reviews must be honest and based on genuine experience. Fixiyo may remove unlawful, misleading,
abusive, infringing, unsafe or irrelevant content.
11. Completion, OTP and Service Records
A completion confirmation, one-time password, digital signature, photo or status update may be used as
evidence that work reached a stated stage. It does not prevent a customer from reporting a genuine defect,
incomplete work, unauthorized charge or hidden issue.
12. Warranties and After-Service Support
Any service warranty, parts warranty or workmanship guarantee applies only if stated in the booking, invoice
or applicable service policy. Coverage may exclude misuse, unrelated faults, pre-existing damage, unauthorized
repair, consumables, normal wear, customer-supplied parts or conditions outside the provider’s control.
13. Prohibited Conduct
You must not use the Platform to:
- Break the law, threaten, harass or discriminate.
- Submit false bookings or reviews or impersonate another person.
- Interfere with security, introduce malware, scrape or reverse engineer except where law permits.
- Misuse another person’s data or avoid authorized fees through deceptive off-platform arrangements.
- Use the Platform for emergencies or hazardous work outside the listed service scope.
14. Intellectual Property
The Platform, software, design, trademarks, logos, text and other Fixiyo materials are owned by or licensed to
Tecsa and protected by intellectual-property laws. We grant you a limited, personal, revocable,
non-transferable licence to use the Platform for its intended purpose.
15. Third-Party Services
The Platform may rely on third-party maps, payment processors, app stores, social login, communications and
other services. Their separate terms and policies may apply. Fixiyo is not responsible for interruptions or
acts of third parties beyond our reasonable control.
16. Suspension and Termination
You may stop using Fixiyo at any time and may request account deletion. We may restrict, suspend or terminate
access where reasonably necessary for security, fraud prevention, non-payment, repeated cancellation, unsafe
conduct, violation of these Terms, legal compliance or protection of users.
17. Disclaimers and Liability
Fixiyo will provide the Platform with reasonable care and skill. However, availability, uninterrupted
operation, exact arrival times, map accuracy and third-party services cannot be guaranteed. To the extent
permitted by law, Fixiyo is not liable for indirect, special or consequential loss that was not reasonably
foreseeable when the relevant booking was made.
For claims directly arising from a booking, and to the extent permitted by law, Fixiyo’s aggregate liability
will not exceed the amount paid for the affected booking. This limitation does not apply to liability that
cannot legally be limited or excluded.
18. Indemnity for Misuse
To the extent permitted by law, you will be responsible for losses, claims and reasonable costs arising from
your unlawful misuse of the Platform, your material breach of these Terms, or content you submit that
infringes another person’s rights. This clause does not require a consumer to indemnify Fixiyo for Fixiyo’s
own negligence or legal breach.
19. Complaints and Disputes
Please first contact Fixiyo support at
tecsa.softwaremobile@gmail.com and provide the booking
reference, issue and requested resolution. These Terms do not prevent either party from seeking urgent relief
or using a legally available consumer or regulatory process.
20. Governing Law
For services delivered in India, these Terms are governed by the laws of India, and courts with jurisdiction
in Kolkata, West Bengal will have jurisdiction, subject to mandatory consumer-law rights. For services
delivered in Malaysia, these Terms are governed by the laws of Malaysia, and the courts of Kuala Lumpur will
have jurisdiction. For services delivered elsewhere, the mandatory laws and competent courts of the service
location may apply.
21. Changes to the Terms
We may update these Terms to reflect changes in the Services, law or business operations. We will post the
revised Terms with a new effective date and provide additional notice where required. Changes will not
retroactively reduce rights for a completed booking without lawful basis.
22. General
If any provision is invalid or unenforceable, the remaining provisions continue in effect. A delay in
enforcing a right is not a waiver. You may not transfer your account or rights without our consent. We may
transfer these Terms as part of a lawful corporate restructuring or business transfer, provided this does not
reduce mandatory rights.
